Service agreement

The plain terms for a My Storefront shop, run for you by HATTECH on a pay-as-you-go basis. The short version first; the detail follows.

The short version

  • The first seven days are free, with no card and no obligation. If you don't subscribe, the shop simply closes to buyers and waits for you.
  • After that it is pay as you go: $1 a day, billed as $30 a month in advance, with no contract and no minimum term.
  • Buyers pay you directly, through your own Stripe or PayPal account, by bank transfer or in the shop. We never hold your money and take no commission.
  • Cancel any time from your account. You won't be charged again, and your shop stays open to the end of the month you have paid for.
  • Your items, photos, words and your own domain stay yours.
  • We give you 30 days' notice of any price change, and you can leave before it applies.

1. Who this agreement is with

This agreement is between you and HATTECH Limited, a New Zealand company based in Christchurch ("HATTECH", "we"). It covers My Storefront: a shop website we host and look after for you at an address like yourshop.mystorefront.website, or at your own domain ("your shop"). You accept it when you tick to accept and open a shop, and again when you subscribe, for yourself or for the business you name.

2. The free week

Opening a shop costs nothing and commits you to nothing. A shop belongs to a business with a website of its own. Whoever opens it shows the website is theirs, either by using an email address at that website's domain or by adding a DNS record we give them to that domain, and confirms their email address with a link we send. The shop opens when that is done; a shop not confirmed within a day (a week, for the DNS record) is let go and its address becomes free again. We may close a shop opened in someone else's name. Your shop is open to buyers for seven days from the day you confirm it. If you don't subscribe by then, it closes to buyers: nothing is charged, you don't need to tell us, and everything in it is kept for you (see section 9). Subscribe during the free week and the days you have left stay free.

3. Pay as you go

A subscription is month to month with no minimum term: $1 a day, billed as $30 a month in advance, by card or Apple Pay through our payment provider Stripe. We never see or store your card details. Prices are in New Zealand dollars and include GST where it applies, and you get a receipt for every payment.

4. What the price includes

Hosting your shop and its photos on our infrastructure, a secure connection, the cart and checkout, an email for every sale and enquiry, the line that puts your shop on another website, keeping the software up to date and secure, backups, help by email, and fixing anything of ours that goes wrong. A shop can have up to 200 items on show at once; if you need more, ask us. Design work, a custom storefront or anything beyond the service as described is quoted first, and you can always say no.

5. Your sales are yours

You are the seller. Buyers pay you directly: into the Stripe or PayPal account you connect, by bank transfer to the account you give, or in your shop. We are not a party to any sale, we never hold the money, and we take no commission. What you sell, how you describe it, prices, delivery, refunds and any dispute with a buyer are between you and the buyer and, where a card or PayPal is involved, your payment provider. You must meet your own obligations to buyers under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply to you.

The keys you give us for your Stripe or PayPal account are kept encrypted and used only to take payments for orders placed in your shop. You can remove them at any time from your Payments page.

6. Your address

Addresses under mystorefront.website are ours, and yours to use while you have a shop with us. We may change or withdraw an address that impersonates someone, infringes a trade mark or is misleading, and we will tell you if we do. A domain name registered in your name stays yours; we attach it to your shop when you ask, and help you point it elsewhere when you leave.

7. Cancelling

You can cancel at any time from your account, with no fee and no notice period. Cancelling stops all future payments. Your shop stays open to buyers until the end of the month you have already paid for, then closes. Until then you can change your mind and keep it from the same page. Because each month is paid in advance, we don't refund part of a month, except where the law requires it.

8. Missed payments

If a payment doesn't go through, we let you know and Stripe tries again over the following days. You can update your card from your account. If the payment still can't be taken, the subscription ends and your shop closes to buyers.

9. When a shop is closed

We keep a closed shop, its items, photos and sales, for 90 days. Subscribe again in that time and it opens straight back up. After 90 days we may delete it. Ask us at any time and we will send you a copy of your items and photos.

10. Your content and our work

Your content (your items, photos, words, logo and other material) stays yours, and you allow us to show it on your shop and in the emails it sends. By putting it up you confirm you have the right to use it. The design and software behind My Storefront, and the infrastructure it runs on, stay ours, and you have the use of them for as long as you have a shop with us.

Your shop must not be used for anything unlawful, misleading or harmful, or to sell anything that is unlawful to sell in New Zealand. If it is, we may close it and will tell you why.

11. Changes to prices and this agreement

We email you at least 30 days before any change to your price or to this agreement. If you don't agree, you can cancel before the change applies.

12. Your rights under New Zealand law

Nothing in this agreement takes away rights you have under New Zealand law that can't be taken away, including under the Fair Trading Act 1986. If you are in business and use My Storefront for the purposes of your business, you agree that the Consumer Guarantees Act 1993 does not apply between you and us, to the extent the law allows. This agreement is governed by New Zealand law.

13. Responsibility

We take care to keep your shop online and working, but no service can promise to be available all the time, and we are not responsible for your payment provider, your bank or a buyer. To the extent the law allows, we are not responsible for indirect losses such as lost sales or profits, and our total responsibility to you is limited to the amount you paid us in the three months before the problem arose.

14. Privacy

We keep your name, contact details, your shop's content and your billing history to provide your shop, bill for it and support you. We keep the orders and enquiries your shop receives, including buyers' names and contact details, so that you can see and fulfil them; they are shown to you and not to anyone else. Card and PayPal details are handled by Stripe and PayPal and never reach us. We don't sell or share anyone's details for marketing. You, and your buyers, can ask to see or correct what we hold, as the Privacy Act 2020 allows.
